Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Fild website (https://www.fild.co.uk) website operated by Fild.

1. Acceptance of Terms

Your access to and use of the Fild website (www.Fild.co.uk) is subject exclusively to these Terms and Conditions. You will not use the Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website.

2. How Fild works

Fild is an online platform which connects Experience Creators ( 'Creators' ) with Users to deliver live experiences and tours.

Creators create an experience profile. All Creators go through an vetting process, which is conducted by Fild. Once approved, Creators can create and list experiences on the Fild website. Experiences can be listed as either Online (i.e. attend virtually) or In-Person (i.e. attend physically).

All details will need to be provided by the Creator, prior to an experience being listed. Creators are responsible for setting their own price, and the terms of the experience. Users will have the opportunity to browse through all experiences listed on the Fild website. Once a User selects an experience, they can make an enquiry. Once accepted, they will be sent a Payment Link to confirm the booking. After the payment has been successfully taken, Users will receive a confirmation email from Fild. A calendar invite to the experience will also be sent out.

Fild acts as a platform to allow Creators and Users to connect and attend live experiences. Fild is not party to any arrangements between Creators and Users, and does not manage any experiences. It is the sole responsibility of the Users to make their own decision with regards to any arrangements provided by a Creator.

3. Booking Fees

Users will have to pay a fee to make a booking. The fee is a fixed 5% of the total booking price. It will be clearly visible on the payment checkout page.

All payments are processed through our third party provider and no payment information is retained by Fild.

4. User Payments

The payment processor used to process User payments is Stripe.

5. Creator Payouts

Creator payments will be processed via Bank Transfer (UK Creators) or Transferwise. Any fee associated with a payout will be paid by the Creator.

6. Complaints

Should you have any complaints about any aspect of Fild’s service, then please contact support@fild.co.uk. This will be reviewed internally and we will aim to respond within 48 hours.

If your complaint is with regards to an experience that you have attended, then a refund may be provided. This will be entirely up to the discretion of Fild, based on our investigation.

7. Cancellations

Whilst we endeavour to ensure that all experiences proceed as planned, there may be some unfortunate instances where an experience has to be cancelled. In the experience that an experience is cancelled, Users will be fully refunded within 48 hours using the same method of payment.

If a User wishes to cancel attendance to an experience, they will be refunded in full if more than 24 hours before the experience. If it is less than 24 hours before the experience, no refund will be refunded.

8. Abuse

Any form of abuse during any Fild experience by a Creator or User will not be tolerated in any shape or form. Abuse may include verbal threats, threatening behaviour, abusive or foul language. Any Creator or User who breaches the Abuse guidelines will be investigated internally in the first instance. This may lead to a formal warning, or in more serious cases, termination of an account.

9. Creators

All Creators will need to be approved by Fild prior to commencing experience hosting duties. 

Creator provide the experience that Users will attend. It is the responsibility of the Creator to provide all content and knowledge of the experience. For online experiences, Creators will need to maintain a sufficient network speed to connect to the internet.

10. Reviews

All Users are encouraged to review a Creator after an experience. Users are encouraged to conduct a review using Google Reviews.

In the experience of a disputed review, Creators should contact Fild in the first experience – via support@fild.co.uk providing more information on the review.

11. Age restrictions

Experiences provided on the Fild website are designed for persons who are 18 or older. Any users under the age of 18 are prohibited from using this website and any of the services provided.

12. Disclaimer and Limitations of Liability

The Website is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

To the extent permitted by law, Fild will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of the Website.

Fild makes no warranty that the functionality of the Website will be uninterrupted or error free, that defects will be corrected or that the Website or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of Fild for death or personal injury as a result of the negligence of Fild or that of its employees or agents.


13. Indemnity

You agree to indemnify and hold Fild and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Fild arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this website.

14. Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

15. Governing law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.
